Experience is crucial in real estate legal matters.  Our Real Estate Group consists of a team of attorneys and staff widely experienced in assisting corporate and individual clients with all types of real estate matters. This team handles both commercial and residential real estate transactions, representing buyers, sellers, landlords, tenants, lenders, borrowers, developers and investors.

The real estate practice group also handles loan workouts and loan restructurings of real estate secured loans on both the lender side and the borrower side, as well as working closely with our Commercial Law Group in handling foreclosures and collections in both North Carolina and South Carolina.  Additionally, our team assists with real estate matters in the context of bankruptcy cases on behalf of creditors, creditors’ committees and occasionally debtors.

Commercial Real Estate

We assist our commercial real estate clients, including developers and lenders, with the acquisition, development, financing and disposition of all types of commercial real estate.

  • Assistance in negotiating and drafting purchase and sale contracts, leases for office space, retail space and other commercial properties
  • Commercial loan transactions
  • Drafting of restrictive covenants, development agreements, master declarations and related governing documents for mixed use developments and master planned communities
  • Zoning, permitting and other land use issues.
  • Section 1031 tax-deferred exchanges
  • Condemnation and other land related disputes (boundary line disputes, actions to clear title, etc.)
  • Title insurance

Residential Real Estate

We provide highly personalized service to both buyers and sellers of residential real estate. We tie together the many processes which go into the residential closing, including:

  • Making the required examination of the public records to determine the quality of the seller’s title
  • Gathering all information necessary to prepare the documents itemizing the terms of the sales transaction, including taxes, insurance, closing costs, mortgage amounts, and additional agreements between the parties
  • Preparing and reviewing the legal documents
  • Explaining and supervising the signing of all papers
  • Recording the necessary documents with the proper authorities; and certifying the completed transaction to the lender and title insurance company

From our initial contact with the client through closing and post-closing, our attorneys and staff take the time to keep the client informed and to fully explain the purpose, importance, and effect of each step in the process and each document the client is required to sign in consummating the transaction.
